The Tilting Point lawsuit for violating children's privacy laws has been settled with the California Attorney General and Los Angeles City Attorney. The developer of "SpongeBob: Krusty Cook-Off" breached COPPA and CCPA, leading to a $500,000 settlement and mandatory conduct changes, without admitting liability.

On June 18, 2024, the California Attorney General and Los Angeles City Attorney settled a case against Tilting Point Media LLC for violating privacy laws related to children's data. The video game developer allegedly breached the federal Children’s Online Privacy Protection Act (COPPA) and the California Consumer Privacy Act (CCPA) through their mobile app, "SpongeBob: Krusty Cook-Off." The company agreed to pay a $500,000 settlement and implement several conduct changes without admitting liability.

COPPA regulates websites and apps collecting personal information from children under 13, while CCPA governs the data of children under 13 and minors aged 13 to 15. Tilting Point's app, popular among minors and adults, required users to enter birthdates and allowed children to receive advertising without proper parental consent. The app collected and shared personal information, violating COPPA and CCPA by failing to obtain necessary consent and disclosing practices inadequately.

The three-year order mandates a $500,000 payment and injunctive measures, combining COPPA and CCPA definitions of "collect" and expanding them. Tilting Point must also establish an SDK governance framework to ensure compliance, including identifying SDKs in children's apps, evaluating their settings, and conducting annual assessments of data practices.
