Google AdSense updates revealed for new US state privacy laws

Friday, October 18, 2024

Austin Harris Austin Harris

Google AdSense updates have been announced regarding new state privacy laws taking effect in January 2025 in Iowa, Delaware, New Jersey, Nebraska, and New Hampshire. These updates include changes to data processing terms and expanded use of Restricted Data Processing to comply with new regulations.

Google AdSense has released an important update addressing upcoming privacy laws in five US states. With new privacy regulations taking effect in Iowa, Delaware, New Jersey, Nebraska, and New Hampshire in early 2025, AdSense users and publishers will see key changes designed to ensure compliance and transparency.

Google AdSense updates announced for the new US state privacy laws

In January 2025, states including Iowa, Delaware, New Jersey, Nebraska, and New Hampshire will implement comprehensive privacy laws that impose strict guidelines on data collection, processing, and usage. These laws, such as the Iowa Consumer Data Protection Act and the New Jersey Comprehensive Data Privacy Act, are part of a larger trend across the United States toward stronger consumer data protections.

For example, New Jersey's law requires businesses to enhance transparency on how personal data is used and grants consumers the right to request information about, and even delete, their personal data collected by companies. Similar provisions exist in Delaware and Nebraska, aimed at providing consumers more control over their data.

In response to these new regulations, Google AdSense will supplement its existing Data Processing Terms and introduce updates that reflect the new state laws. However, no action is required from users if they have already agreed to Google's data protection terms, meaning the changes will automatically take effect to align with the new state regulations.

Restricted Data Processing (RDP) is one key feature that will be extended to these five states. If publishers are using RDP, it will now apply to traffic from Iowa, Delaware, New Jersey, Nebraska, and New Hampshire starting November 15, 2024. Publishers in these states may experience an increase in restricted data processing traffic as the laws come into effect.

Google provides various tools to help AdSense users manage their compliance with state privacy laws. Publishers are encouraged to explore these tools through the AdSense Help Center to review relevant settings and features that will help ensure data is handled appropriately under the new regulations. For example, RDP allows businesses to limit the way data is shared or used for ad targeting without users’ consent, thus ensuring compliance with state-level laws.

These privacy laws will have a widespread impact on businesses that collect data from residents of the affected states. Nebraska, for instance, requires any business that processes personal data of over 50,000 Nebraska residents, or those deriving significant revenue from personal data, to comply with the state's new laws. Failure to comply can result in hefty penalties.

For businesses advertising in these regions through Google AdSense, ensuring compliance with these evolving privacy standards is crucial. Companies may need to adjust their data processing methods, with an emphasis on transparency, data minimization, and providing consumers with the ability to opt out of data collection where applicable.

The AdSense Restricted Data Processing feature offers a compliance-friendly solution, particularly for publishers operating in multiple states with varying privacy laws. As the US privacy law landscape continues to evolve, tools like RDP help simplify the complex task of adhering to state-specific requirements while still engaging in effective advertising practices.

Key takeaways

  • New privacy laws will take effect in Iowa, Delaware, New Jersey, Nebraska, and New Hampshire in January 2025, impacting how businesses collect and process data.
  • Google AdSense is updating its Data Processing Terms in line with these new regulations. No further action is required if users have already accepted existing terms.
  • Restricted Data Processing will apply in these states as of November 15, 2024, and publishers may see an increase in restricted traffic.
  • Publishers should use AdSense tools to review their privacy settings and ensure compliance with these state laws.
  • Businesses must be aware of varying state requirements regarding data transparency, user consent, and data minimization to avoid potential fines and penalties.
